Some call it weed. Others call it Mary Jane, pot, hash, ganja, or dope. Whatever it is called, marijuana is one of the most controversial plants in our world today. Frequently demoralized in society, its users are young and old, from every socioeconomic group and racial background, and their reasons for use are equally vast. Commonly used for recreation, marijuana’s medical potential has been gaining popularity, and in 2008 Michigan voters approved the establishment of the Michigan Medical Marihuana Program (MMMP) (the spelling for the policy is consistent with previous legal policies). As research continues to evolve, science is finding more uses for marijuana in alleviating the symptoms of many debilitating illnesses. However, the policy is still in its infancy, and many limitations exist. As social workers, it is important to educate ourselves on marijuana’s controversial presence in today’s society, and find ways to promote safe, legal use of this widely misunderstood plant. In this act it is classified as a Schedule I drug, deemed to have a high potential for abuse and no legitimate medical uses. As such, it prohibits the possession, usage, purchase, sale, and cultivation of marijuana. The federal Drug Enforcement Administration has continued to raid many medical marijuana dispensaries that were operating in accordance with their state’s laws. The United States Supreme Court ruled in United States v. Oakland Cannabis Buyers’ Coop and Gonzales v. Raich that the federal government has the authority to regulate and criminalize cultivation and distribution of cannabis under the interstate commerce clause, as even purely intrastate sales will affect the market price in other states by altering nationwide supply and demand patterns. California passed Proposition 215 in 1996, later renamed the Compassionate Use Act, which would protect anyone from criminal prosecution if recommended by a doctor to use marijuana for relief from some serious illnesses such as cancer, anorexia, AIDS, and glaucoma. In early 2009, California state representative Tom Ammiano introduced a bill, titled Marijuana Control, Regulation, and Education Act, to legalize, regulate, and tax the recreational use of cannabis in California.
